The framework of international trade and of carriage of goods by sea pursuant to an international sale of goods contract and the fundamental concepts concerning liabilities of parties in the procedure of transportation of those goods.
Practitioners in the shipping industry must be aware that no international sale or bills of lading contract exists in a vacuum: both contracts will frequently involve goods being carried on a chartered ship with or without financing. In this course students will develop their understanding of the relationship between the sale and bill of lading contracts with the rights and liabilities under charterparties and move on to examine in depth the legal principles (i) of three main charters that exist: (a) the time charter, (b) the voyage charter and (c) the demise or bareboat charter; and (ii) of dispute resolution in shipping and enforcement procedure including the arrest of ships. Necessary, activityspecific knowledge and understanding in the shipping industry is provided.
As a result of taking this course, the student should be able to:
1. Analyze the different types of charterparties and the respective rights and obligations of the parties concerned. (analysis)
2. Analyze the main principles which govern charterparties and bill of lading. (analysis)
3. Solve practical problems related to the contractual and operational aspects of carriage of goods by sea, and assess standard forms of maritime contracts. (application and evaluation)
4. Distinguish between the different types of dispute resolution in shipping. (Analysis)
5. Demonstrate understanding of the options in an enforcement scenario and select the optimum option taking into account commercial considerations (analysis and evaluation)
METHOD OF TEACHING AND LEARNING:
In congruence with the learning and teaching strategy of the college, the following tools are used:
• Classes consist of lectures, discussions, collaborative in-class small projects, experiential exercises and discussion of actual cases by the course instructor as well as guest speakers specialists in their respective practice area. Throughout the lectures students develop knowledge and understanding related to the subject content. Discussions and collaborative in-class small projects reinforce students’ cognitive and key transferable skills. The discussion of actual cases familiarizes students with professional skills and further develops their cognitive skills.
• Office Hours: Students are encouraged to make full use of the office hours of their instructor in order to consult and discuss issues related to the course's content.
• Use of blackboard site, where instructors post lecture notes, assignments instructions, timely announcements, as well as additional resources.
